We try to keep things nice and simple. To avoid arguments, disputes and misunderstandings we all need to know the rules. We will always try to be flexible so if you have any queries please do get in touch. Our aim is to do the best for each and every client. We also want to provide solicitors with an efficient and reliable service and we want our reps to provide clients with a professional service. Keeping everyone happy at all times is not an easy balancing act but we will always do our upmost to acheive these three often competing goals. When a firm instructs us or we instruct a rep they agree to these terms.

1. QUICK START & OVERVIEW FOR INSTRUCTING SOLICITORS
  1. We accept instructions from solicitors by any method including text, email & telephone.
  2. An instuction is defined enough information to attend upon a client. At a minimum that would be the name of the cleint and the venue.
  3. Once instructed we will instruct a rep to attend for interview if a time is known.
  4. Our reps always call ahead with an ETA. If you get a call from the police please give them our number. We will deal with and manage the police.
  5. If it is not ready we will call custody and leave our details so they can call us when it is ready.
  6. We are happy to take calls from the the police and client during the period in which we are instructed.
  7. We are also happy to deal with inital calls, extensions and general enquiries on behalf of the firm.
  8. If there are any problems we will immediatley inform the firm.
  9. When the case is concluded we will provide a result by text or email. If you do not have a result for a case please check our portal or call us.
  10. A summary report will be sent within 24 hours by email and the full set of handwritten notes by post.
  11. After the interviews have concluded we are no longer invovled. We will have no further dealings with your cleint or the police. But we will of course be only to happy to assist with any queries the firm may have. Mesages will be forwarded if we revceive calls from the police or your client.
  12. We do not log cases with the DSCC. The firm needs to log cases.
  13. We would like our invoices to be settled within 30 days. Invoices are sent with the summary notes by email and a hard copy is posted to your offices.
  14. We publish all the reports and invoices along with a host of other information on our web portal. Do please take a look.
  15. Our web development is all inhouse. We can tailor our services to your needs. Let us know what you want. Any feedback is much appreciated.

3. INSTUCTED REPS AGREE TO:
  1. By accepting these terms and conditions, you confirm you have read, understood and accepted its contents. Accepting these terms and conditions is a condition of being instructed by No Comment. All reps are obliged to observe these terms and conditions. Acceptance of our instructions is strictly in accordance with our terms and conditions. By accepting our instruction you accept our terms and conditions. We email you with our terms and they are here for you to read as well. We are not agreeing to your terms. You are agreeing to ours! If you have any questions about them do please get in touch.

  2. Put the client first. We are at the police station to represent the client and follow his instructions. The client is the boss and we as reps are only present at the station to give the best legal advice.

  3. Scan the first page of our front sheet and email it to us. Our police station attendance form is on the right. Try it out at least. It is short and contains everything an instructing solicitor needs. If you have a better form let us take a look at it.

  4. Record times! Under the Criminal Contract the solicitors still need to report them.

  5. Send the results and invoices to us by post or email or text as soon as possible. The quicker we bill the instructing solicitors the quicker we can pay you.

  6. Send papers direct to the solicitors as soon as you can. Under the contract solicitors are meant to receive papers within 24 hours. First class post should be fine but DX is better. Scan the front sheet and then email it to us.

  7. Always complete CRMe14 the online declaration form so the firm can apply for legal aid. Whilst you do no need to complete the CRM14 & you do need to gather the financial information from every client that was formely captured in those forms. You should always complete the CDS1 & CDS2 forms. Sometimes it may appear pointless but please do it every time.

  8. Provide us with a copy of your CV and ensure we have your correct bank details and address.

  9. Please sign our GDPR Agreement. It is there to protect you. Under GDPR you are responsible for any errors made any the instructing firm if there is no written agreement. Our Agreement will protect you and No Comment. Please sign it.

  10. Invoices are paid as soon possible. The industry norm is around three months and we average about 60 days. But we are in a chain. The firms will often only pay when they are put in funds by the LAA. The LAA sometimes only pays when a case has been completed. We all know cash flow is king and we chase bad debt continuously. We never forget an invoice!

  11. We pay your invoices as soon as we have been put in funds by the instructing solicitor. We pay at the end of each month. But we are not a faceless, heartless corporation so if you are having financial problems please feel free to get in touch.

  12. But please note that if we are not paid then you will not be paid. If a firm goes bust we will not be able to pay you. We pay when we are in funds *.

  13. Upon request you must provide to us within a reasonable amount of time any documentation which can be used to demonstrate you are a qualified police station represenattive able to accept instruction. This would include confirmation of your supervising solicitor, a copy of your CPD logs and qualification certificates.

  14. Any instructions is based on the General Criminal Contract. Since Lord Carter there has only been one fee. If the matter goes to second interviews there is no more money! An instruction is for one fee. That fee includes any necessary second attendances. If we have to instruct a second rep because the first cannnot attend a subsequent attendance then the first rep may recieve nothing more than travel disbursements. Its a rubbish contract but blame Lord Carter not us!

  15. Got a problem? Ask for help! Matthew is a Duty solicitor and Caroline is an accredited rep. If you have any legal questions or procedural issues that arise whilst on a job do feel free to call us at any time for advice. We keep copies of Archbold and Ed Cape to hand. Please feel free to ask for any advice or guidance you may need.

  16. Keep us in the loop! Delays are inevitable and we appreciate that we are all very busy. If you are delayed let us know so that we can keep custody, the OIC and the instructing solicitors up to date. The biggest moan we get is reps turning up later than expected. We can stop those moans by managing everyone's expectations. If its going to take you longer than 45 minutes to get to an interview location please tell us before accepting an instruction.

  17. Ensure you have an identification card. The contract (clause 6.63 and 9.46) specifies that all staff undertaking Police Station work must carry an identification card as specified by the LAA. An ID card from the CLSA costs £35 and is available from here. The LCCSA card is £36 and available here

  18. No Comment reserves the right to update these Terms & Conditions. We are in an industry where the Criminal Contract and the Criminal Law is updated and newly interpreted on a regular basis. Our terms will reflect any changes so do please keep an eye on these terms as we will from time to time update and improve them.

  19. Should an instructing solicitor firm cease to trade we reserve the right to reclaim any monies paid to a rep where No Comment has paid the rep prior to the client solicitor invoice being paid. If we have not been paid by the firm but we have paid the rep out of our own pocket we will require the money to be returned.*

  20. All reps are self-employed. They are wholly responsible for the payment of their own tax and national insurance.

  21. All reps are responsible for keeping up to date with any and all requirements imposed on them to remain in practise. All reps are responsible for ensuring they have a Supervising Solicitor and obtaining CPD points along with any other requirements imposed by the Law Society, Legal Aid Agency or other supervising body. Should you be barred for any reason from continuing to practice No Comment must be informed immediately.

  22. In the event of a dispute No Comment will be the arbiter and make all final decisions.

  23. No Comment reserves the rights to alter or update the terms and conditions at any time.

  24. * That clause sound terrible. Reclaiming money? WTF!? Lets be frank we have never reclaimed monies paid to a rep. We operate on small margins so these clauses are all here to cover us in really extreme circumstances. Its very, very rare indeed that such a situation would arise. We merely reserve our rights. We spend a great deal of time getting to know instructing solicitors and we keep on top of the payments. Don't worry, you will get paid but if the sky falls down we have clauses to protect us from going out of business. If we hit the wall a lot of reps will lose money.

4. INSTRUCTING SOLICITORS AGREE TO
  1. By accepting these terms and conditions, you confirm you have read, understood and accepted its contents. Accepting these terms and conditions is a condition of instructing No Comment. All instructing firms are obliged to observe these terms and conditions. Instructions are strictly in accordance with our terms and conditions. By instructing No Comment you accept our terms and conditions. We can at any time email you with our terms and they are here for you to read as well. We are not agreeing to your terms. You are agreeing to ours! If you have any questions about them do please get in touch.

  2. Pay the invoice promptly. We expect payment to be made as soon as possible. We note that the General Criminal Contract states that payments for third parties should be made within 30 days' (Clause 3.3). However, we are not unpleasant or faceless though so if you are having financial problems do please speak to us. We only get nervous when firms get quiet!

  3. Please ensure you obtain a DSCC reference number. We do not ask our reps to get it.

  4. Upon request provide us with the UFN of a matter one of our reps dealt with so that the rep can maintain their compliance record.

  5. Please provide us with an email address for our invoices and reports.

  6. Do note that we encourage all our reps to fill in Legal Aid forms. However we cannot guarantee that this will be done each and every time.

  7. No Comment doesn't chase up subsequent bails. So if your client is going to have a second interview do please let us know. We try to cover second interviews as part of the fixed fee but do give us a call as there are regional variations.

  8. Sadly with the advent of Shadow Charging and Fixed Fees the reps are no longer present at charge. Getting results is a nightmare particularly from busy stations. We do try to get bail conditions but it is not always possible.

5. No Comment AGREES TO:
  1. Put the client first. Our reps are at the police station to represent the clients' best interests. Its our role to support both the instructing firm and the rep.

  2. Be available 24/7 to assist you and our reps.

  3. No Comment is run by police station reps and solicitors so we are happy to take any questions our reps may have, whether legal or procedural. Please feel free to call or text any time for advice.

  4. Keep both the instructing solicitors and our reps fully informed at all times.

  5. Monitor our reps and ensure that they are fully qualified, up to date with their CPD points and up to date with current case law and statute. We also ensure that they are suitably insured and competent.

  6. Nag the instructing solicitor if they do not pay our bills on time!

  7. Provide instructing solicitors with the results and disposal decisions promptly. You can get results from our website and we normally text them before the courts open. If you have not had a result by 09:30 the next morning do please call us!

  8. We do not chase up subsequent disposals. If your client is bailed we will tell you but we will not find out what happened on the subsequent bail date.

WEBSITE TERMS OF USE

Banking, Billing or Other Online Services.
Access to Online Banking, Online Payment, and any other services available through the Internet and selected No Comment products (the ‘Online Service’) is provided by your financial institution and not No Comment. You agree not to hold No Comment liable for any loss or damage of any sort incurred as a result of any such dealings with any services provided by your financial institution. Your access may be limited from time to time, depending on the service provided by your Internet service provider or your financial institution. You may be billed for these Online Services by your financial institution, not No Comment, and such financial institution may have its own service agreement which will govern the Online Services it provides. You agree to be responsible for all telephone charges associated with your Internet and online service usage.

Termination and Amendment.
Your privilege to use or access the Site may be terminated by No Comment immediately and without notice if you fail to comply with any term or condition of the Terms. Upon such termination, you must immediately cease accessing or using the Site and agree not to re-register or otherwise make use of the Site. Furthermore, you acknowledge that No Comment reserves the right to take action -- technical, legal or otherwise -- to block, nullify or deny your ability to access the Site. Miscellaneous.

In the event of a conflict between these Terms of Service and the Privacy Policy, these Terms of Service shall prevail. The Suppliers, agents, distributors, dealers, and employees of No Comment are not authorized to make modifications to the Terms, or to make any additional representations, commitments or warranties binding on No Comment. Any waiver of the terms herein by No Comment must be in a writing signed by an authorized officer of No Comment and expressly referencing the applicable provisions of the Terms. If any provision of the Terms is invalid or unenforceable under applicable law, then it shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. The Terms will be governed by California law as applied to agreements entered into and to be performed entirely within California, without regard to its choice of law or conflicts of law principles that would require application of law of a different jurisdiction, and applicable federal law. The parties hereby consent to the exclusive jurisdiction and venue in the state courts in Santa Clara County, California or federal court for the Northern District of California. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
